General contractual terms


1.           Object of the contract

1.1         

The apartments shall only be used for private use. Any commercial use shall not be permitted or shall require the express written consent of the landlord.

1.2         

The landlord shall be entitled to immediately terminate the contract if:

- If the maximum number of persons stipulated in the contract is exceeded

- The keeping of pets

- Smoking in the apartment

1.3         

In case of any booking issues, is the landlord entitled to rent another object (as mentioned on the front page of the contract) to the tenant. But it must be in the same house, identical size and in same quality as the apartment mentioned on the contract.


2.           Period of the contract and payment / Withdrawal from the contract

2.1         

The rent shall be paid monthly in advance on the first of each month. The first rent payment and the security deposit shall be paid within 7 days after conclusion of the rental agreement unless the tenancy starts earlier.

2.2         

The tenant can withdraw from the contract in writing (letter or fax) up to 10 days before the beginning of the rental agreement. In this case, liquidated damages of 75% of the agreed rent for the entire rental period (until the time of the first possible termination of the rental agreement) shall however be due to the landlord. In all other cases, the full rent shall be due to the landlord.

2.3         

As soon as the tenant falls into rent arrears or arrears with other costs, the landlord shall be entitled to immediately change the lock and key to the apartment and to remove the property of the tenant from the apartment

2.4         

The tenant and the landlord shall terminate the contract in writing, letter or e-mail

2.5         

The landlord shall be entitled to directly deduct from the security deposit any rent arrears, costs or damage to the furniture.


3.           Access to the apartment

3.1         

The tenant shall grant the Landlord permission to visit the apartment at any time (weekdays from 8 a.m. to 6 p.m.) without consulting the tenant. For this purpose, a key to the apartment shall remain with the Landlord, we try to not disturb the privacy.


4.           Handing over of the rental object / return of the rental object

4.1         

The rental object shall be handed over at the time stipulated in the Rental Agreement (at the latest 5 p.m.). The object (incl. the furnishings and the furniture) shall be handed over to the tenant in a complete and flawlessly clean state. The Inventory list is part of this contract. The tenant must report any defects immediately, but no later than 10 working days after handover of the apartment.

4.2         

The rental object shall be returned at the time stipulated in the Rental Agreement (at 9.00 a.m. on the last day). The object (incl. the furnishings and the furniture) shall be returned in a complete and flawlessly clean state. In the case of any delay in the return of the rental object, the tenant shall be liable for damages

4.3         

If the cleaning of the object is not flawless or the object shows any signs of damage, (incl. to the furnishings and the furniture) then these costs shall be paid by the tenant. The costs will be charged to the tenant or will be directly deducted from the deposit if available.


5.           Reimbursement of the security deposit

5.1         

The security deposit shall not be reimbursed until the end of the rental relationship. Any damage or rent arrears shall be directly deducted from the security deposit.

5.2         

The security deposit shall be reimbursed without interest.


6.           Place of jurisdiction

6.1         

The place of jurisdiction shall be the location of the object. Swiss law shall apply.
